Chapter 9 - The Trust Fund Trap

That evening, our living room looked like a legal war room.
Sitting across from us was Brenda Clark, a forensic accountant and estate attorney whom Evander had hired immediately following the arraignment. She had spent the last eight hours combing through the original trust documents executed by Evander’s late father, Charles Vance.
"It’s worse than you thought, Evander," Brenda said, sliding a thick ledger across our coffee table.
Evander rubbed his bruised cheek. "What did they do?"
"Your father’s original trust was designed to be equitable," Brenda explained, pointing a pen at a highlighted clause on page forty-two. "You and Serafina were each supposed to receive fifty percent of the commercial portfolio, while Delphine retained a life estate in the family manor and a generous annuity. But look at the amendment dated six months before Charles passed."
I leaned over to read the dense legal prose. "An amendment? Charles was heavily medicated with late-stage pancreatic cancer during his last six months."
"Exactly," Brenda nodded. "And look who notarized it. Arthur Pendelton."
Evander’s hands clenched into fists. "What does the amendment say?"
"It contains a subterranean forfeiture clause," Brenda said grimly. "If either sibling is convicted of a felony involving moral turpitude, their entire share of the estate is immediately forfeited and transferred to the surviving sibling. However... if either sibling marries someone with a criminal record of violent felony convictions, their share is also liquidated and placed into a blind trust administered exclusively by Delphine."
The cold, calculating horror of the scheme settled over the room.
"They were trying to frame Maya for felony assault," Evander breathed, his voice trembling with rage. "If Serafina pushed Maya into a fight, provoked her into throwing hands, and Arthur helped them press felony charges against Maya... I would have been legally pressured to divorce her, or I would have lost every dime my father built to my mother."
"And when that failed," I added, looking at the documents, "Serafina ended up catching the felony charge herself."
"Which means," Brenda said, closing the folder with a sharp thud, "if Serafina is convicted of aggravated assault at trial, she loses her entire half of the Charles Vance estate. Everything reverts unconditionally to Evander. Delphine’s allowance gets terminated. They lose the house, the cars, the trust income—everything."

"They're facing total financial annihilation," Evander said.
"And people facing total annihilation," I murmured, staring out the front window into the darkening street, "do not go quietly into the night."
